Report and determination: Deputy Clerk of the Parliaments

REPORT:

  1. On 24 May 2007 the Premier, the Hon Morris Iemma MP, advised the Tribunal that the Deputy Clerk of the Parliaments, Mr David Blunt, had elected to receive employment benefits pursuant to section 11B of the Statutory and Other Offices Remuneration Act 1975 (“SOOR Act”). The Premier has approved Mr Blunt’s election and has directed the Tribunal, pursuant to Section 14(1) to make a determination to reflect the changed employment arrangements.


  2. On 30 April 2002 the Tribunal made a determination in respect of motor vehicle allowances for certain office holders within the Public Office Holder Group. That determination identified a number of public office holders who were eligible to receive a motor vehicle allowance if they elected to forgo any existing arrangement to be provided with a motor vehicle under their current conditions of employment


  3. Following that determination a number of public office holders elected to forgo their existing entitlements and receive the allowance. Approval was also given, in accordance with section 11B(3)(a) of the SOOR Act, for those officers to salary sacrifice for a motor vehicle in accordance with normal public sector procedures. At that time the former Deputy Clerk of the Parliaments opted to retain the existing employment arrangements and was not eligible to receive the motor vehicle allowance. The former Deputy Clerk received an annual salary of $156,370 per annum plus a motor vehicle.


  4. Mr Blunt was appointed to the position of Deputy Clerk in February 2007. As advised by the Premier Mr Blunt has elected to have the employment benefit previously provided to the former Deputy Clerk (the motor vehicle) included in his salary. To facilitate this the Premier has approved Mr Blunt’s election to be provided with employment benefits (motor vehicle) pursuant to section 11B(3)(a) of the Act. Mr Blunt’s election complies with the Government’s policy which provides for motor vehicles through normal public sector salary sacrifice arrangements only.


  5. In making its determination the Tribunal has had regard to the value of the entitlement previously available and its previous determinations in regard to this matter, in particular the current value of the former motor vehicle allowance and the remuneration of other offices within the Public Office Holders Group.


  6. Having regard to these factors the Tribunal considers the salary of $172,850 is appropriate and so determines.


  7. The Tribunal considers that the new remuneration arrangements for the Deputy Clerk of the Parliament should commence from the date of the Premier’s advice, 24 May 2007.


DETERMINATION:

Pursuant to section 14 (1) of the Act the Tribunal determines that the remuneration for the Deputy Clerk of the Parliaments shall be $172,850 with effect from 24 May 2007.
